These terms are not your service agreement
If you hire us, the work is governed by a separate signed statement of work or service agreement covering scope, fees, term, ownership, and guarantees. That signed agreement controls the engagement. Where it conflicts with anything on this page, the signed agreement wins. Nothing on this website creates a client relationship on its own, and no page, proposal preview, or calculator output is an offer capable of acceptance.
The free tools
We publish tools including a growth scorecard, an ROI calculator, a revenue calculator, a budget planner, an SEO projection, and audit request forms. They are provided free and for general informational use.
- They produce estimates from the inputs you supply and from industry assumptions. They are not a forecast, an appraisal, or professional advice.
- Outputs depend entirely on the accuracy of what you enter. Garbage in produces confident-looking garbage out.
- Do not make a financial, legal, or tax decision on a calculator result alone. Talk to a person, ideally one of ours.

Acceptable use
You agree not to:
- Submit false information, another person’s contact details, or a phone number you are not authorized to give consent for.
- Scrape, crawl, or harvest the site at a rate that degrades it for others, or circumvent any rate limiting or bot protection.
- Probe, scan, or test the vulnerability of the site or its infrastructure, or attempt to access any system or data you were not granted access to.
- Use the site to transmit malware, to send unsolicited commercial messages, or for any unlawful purpose.
- Resell, republish, or present our content, tools, or reports as your own, or use them to build a competing product.

Intellectual property
The site, its copy, design, tools, case studies, brand marks including the ProofPilot and TrackPilot names, and the underlying methodologies are owned by ProofPilot Agency and protected by copyright and trademark law. You may read, quote, and link to our content with attribution to ProofPilot. You may not copy substantial portions, mirror the site, or use our marks in a way that implies endorsement or partnership.
Client names, logos, and marks that appear in case studies belong to those clients and appear with their permission. The performance figures attached to them come from tracked attribution data and are published under the constraints described in the Results Disclaimer.
What clients own. For signed engagements, on final payment the website, pages, and content we build for you are yours, including a full CMS handoff. We keep our own tools, frameworks, and methodologies, plus the right to reference the work in our portfolio. The specifics live in your signed agreement.
Content you submit
You keep ownership of anything you submit through a form. You grant us a license to use it for the purpose you submitted it, which is to respond to you, prepare an audit or proposal, and deliver work you engage us for. You confirm you have the right to share what you submit, including any phone number you provide consent for. How we store and handle it is covered in the Privacy Policy.
Third-party links and embeds
The site links to and embeds third-party services, including the scheduling widget on our booking page. We do not control those services and are not responsible for their content, availability, or practices. Their terms and privacy policies apply when you use them.
Availability
We work to keep the site up but we do not promise uninterrupted availability. We may change, suspend, or remove any part of the site, including any free tool, at any time and without notice.
Disclaimer of warranties
The site and the free tools are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that content or tool output is accurate, current, or complete. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, ProofPilot Agency and its team are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of your use of this website or the free tools, even if we were advised such damages were possible. Our total liability for any claim relating to this website is limited to one hundred US dollars. Liability arising from a signed engagement is governed by that agreement, not by this section.
Indemnity
You agree to indemnify and hold ProofPilot Agency harmless from any claim, loss, or expense, including reasonable legal fees, arising from your misuse of the site, your violation of these terms, or your violation of any law or third-party right.
Governing law and disputes
These terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. Before filing anything, you agree to email [email protected] and give us 30 days to resolve the issue directly. If that fails, the exclusive venue for any dispute relating to this website is the state or federal courts located in Maricopa County, Arizona, and both parties consent to jurisdiction there. Any dispute arising from a signed engagement follows the dispute resolution clause in that agreement instead.
Changes
We may update these terms. The revision date at the top of the page reflects the current version, and continuing to use the site after a change means you accept the updated terms.
